ELISA protects the privacy of Internet users visiting its Site in its capacity as data controller under Law 78-17 of 6 January 1978 (hereinafter the "Loi Informatique et Libertés “) (Data Protection and Freedom of Information Law).   • "Personal Data" means in relation to Article 2 of the Data Protection and Freedom of Information Law” any information relating to an identified individual or individual who can be identified, directly or indirectly, by reference to an identification number or to one or more particulars relating to him or her”. Personal Data comprises data allowing the identification of the Users. PURPOSES OF PROCESSING

The processing of Personal Data undertaken by ELISA through the Site has the following purposes (hereinafter the "Purposes"): to deal with Your questions or requests for information or any other request, to send You advertising or sales canvassing messages, subject to Your agreement, to send You the Newsletter (or an Alert) to which You have subscribed, to inform You about the products, to enable You to enter competitions, to inform You about events, to enable You to follow up the Site and its news (RSS feeds).
The information required for ELISA to fulfil the purposes described above is indicated by an asterisk (*) in the various pages of the Site. If You do not complete the fields marked with an asterisk (*), You may be refused access to all or part of the services and features of the Site and Your requests may not be taken into account. RETENTION PERIODS

The Personal Data collected is stored for the time necessary to achieve the various Purposes described in the preceding paragraph. Thus, Your electronic ID data and data relating to the cookies is stored for thirteen (13) months from the date of its collection. Furthermore, the Personal Data collected is removed following the occurrence of one of the following events: (i) the end of the retention period, (ii) the exercise of Your right of deletion in accordance with the Data Protection and Freedom of Information Law and the terms set out in the  "Your rights of access to Your collected data" in this document, (iii) removal of the Site by ELISA for any reason whatsoever.

RECIPIENTS AND SHARING

In accordance with the purposes described above, Personal Data collected by ELISA may be sent to the following recipients to ensure the operation of the Site and the achievement of the Purposes: relevant services and/or departments of ELISA, services and/or departments of a company of the group to which ELISA belongs, services and/or departments of one of the companies of the group to which ELISA belongs.
ELISA is the sole recipient of the data collected. ELISA only transmits Your Personal Data to a third party if You have given Your express prior consent for the sharing of such information (e.g. commercial offers from ELISA or its business partners), or if ELISA receives a request from a judicial authority or any administrative authority empowered by law to apply for the disclosure of such information in accordance with the legislative provisions in force.

DATA SUBMITTED BY THE USER WITHOUT SOLICITATION BY ELISA

ELISA asks You not to transmit content that is not asked for by a questionnaire or other collection form, such as commercial information, advertising, personal creations, ideas, concepts, etc.  Where You voluntarily provide Personal Data about Yourself, especially multimedia content (photographs, videos etc), You agree to provide accurate information which is not prejudicial to the interests or rights of third parties.

SECURITY MESURES

ELISA does everything possible to protect Your Personal Data against damage, loss, diversion, intrusion, disclosure, alteration or destruction. The ELISA computer systems are equipped with data encryption and software protection. Physical and electronic backup procedures for Personal Data collected on the Site are in place in accordance with French legislation on the protection of Personal Data.  Employees of ELISA who, owing to their duties, have access to Your Personal Data, undertake to the strictest confidentiality in this regard.
However, ELISA does not have control over all risks related to the operation of the Internet and draws Your attention to the existence of possible risks in terms of occasional losses of data or breach of confidentiality of data transmitted via the Internet. The information provided on the Site may be interrupted in the event of force majeure or independently of ELISA’s control or matters not under the responsibility of ELISA.

ACCURACY OF DATA

You declare that You are fully aware of the importance of the accuracy of Personal Data about You and made available through the Site. You accordingly undertake only to make accurate Personal Data available throughout the duration of use of the Site by updating it immediately if one or more items of such Personal Data change during the said use of the Site. The Site is not targeted at minors. Access to the Site is, however, not restricted to adults owing to the fact that it has no content prohibited to minors under eighteen (18) years of age. UPDATING

ELISA may amend this document, such updates being made without prior notice and posted online. The previous version of this document will be automatically cancelled and replaced by the new version which will become immediately binding on all Users. MISCELLANEOUS

In the event that any of the clauses herein are null and void, in particular as the result of a change of law or the decision of a court, this shall in no circumstances affect the validity of and requirement of compliance with the other clauses. In the event of a dispute relating to the validity, performance or interpretation of this document, jurisdiction is conferred, regardless of whether there is more than one defendant, a third-party claim, urgent proceedings or protective, interim or summary proceedings, on the French court with jurisdiction for the place of the defendant’s registered office.
